SMS Messaging Terms & Conditions
Effective date: August 30, 2026
These SMS Messaging Terms & Conditions govern informational text messages sent by Maxwell & Viviani, PLLC (“Maxwell & Viviani,” “the Firm,” “we,” “us,” or “our”). By affirmatively opting in, you agree to receive text messages from Maxwell & Viviani at the mobile number you provide.
Types of Messages
Messages may include consultation and appointment confirmations or reminders, scheduling communications, document requests, case- or service-related updates, account notifications, responses to your questions, and other customer-care or informational communications relating to your interaction with the Firm. This program is not used for affiliate marketing or lead generation.
Message Frequency and Charges
Message frequency varies depending on your communications and the services involved. Message and data rates may apply. Your wireless carrier’s terms and charges govern your mobile service.
Opting Out
You can opt out at any time by replying STOP to a message from Maxwell & Viviani. After you send STOP, you may receive one final message confirming your opt-out. You will no longer receive messages under this SMS program unless you opt in again. We will also honor other reasonable requests to stop communications when received.
Help and Customer Care
For assistance, reply HELP, call (202) 697-7731, or email info@maxwellviviani.com.
Consent
Consent to receive text messages is voluntary and is not a condition of purchasing or receiving legal services. Your consent applies only to Maxwell & Viviani and the messaging purposes described above. Consent to receive SMS messages is not consent to receive unrelated marketing communications.
How You May Opt In
Maxwell & Viviani primarily obtains consent during a prospective-client or client intake telephone call. Consent may also be obtained during an in-person conversation, through a written intake or engagement form, through a website form, or when an individual initiates enrollment by sending an identified opt-in keyword.
Before consent is recorded, the individual is informed that the messages are from Maxwell & Viviani, PLLC; that messages may include consultation and appointment reminders, scheduling communications, document requests, case- or service-related updates, account notifications, and customer-care communications; that message frequency varies; that message and data rates may apply; that replying HELP provides assistance; and that replying STOP cancels future messages. The individual is also directed to the Firm’s Privacy Policy and these SMS Messaging Terms.
For telephone or in-person intake, a Firm representative asks whether the individual affirmatively agrees to receive text messages and records the response. For a website form, SMS consent must be presented as a separate, optional checkbox that is not preselected. For a written form, the individual signs or initials the SMS disclosure. For keyword enrollment, the published call-to-action includes the required disclosures and the individual initiates enrollment by sending the stated keyword. Declining SMS consent does not prevent the individual from submitting an inquiry or seeking legal services.
Privacy
No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text-messaging originator opt-in data and consent will not be shared with or obtained by third parties. Please review the Firm’s Privacy Policy for more information.
Delivery and Availability
Wireless carriers are not liable for delayed or undelivered messages. Message delivery is subject to effective transmission by your wireless provider and is not guaranteed. The SMS program may not be available through every carrier or device.
Attorney-Client Relationship
Opting in to text messages, sending a text, or receiving a response does not by itself create an attorney-client relationship. Do not send confidential or time-sensitive information unless the Firm has confirmed in writing that it represents you in the matter.
Changes to These Terms
We may revise these Terms from time to time. The effective date above will identify the most recent revision.
